CHILI FEST 50/50 PRESENTED BY

Promoter/Sponsor of this Greater Pueblo Chamber of Commerce 50/50 Raffle (the "Raffle") is the Greater Pueblo Chamber of Commerce with an address of 302 N. Santa Fe Ave., Pueblo, CO., 81003. All entrants agree to be bound by the terms and conditions provided in these Official Rules as well as by all interpretations of these Official Rules by the Greater Pueblo Chamber of Commerce and by all other decisions of the Greater Pueblo Chamber of Commerce including resolution of disputes in connection with this Raffle, which are final and binding in all matters relating to the Raffle. The Raffle is subject to all applicable Colorado laws and regulations.

ELIGIBILITY

The Raffle is open to legal U.S. citizens who are at least 18 years of age or older at the time of entry. Employees of the Greater Pueblo Chamber of Commerce, their immediate family members, and the Board of Directors shall not be eligible to enter or win.

ENTRY PERIOD

The Raffle begins on Monday, August 16th. 2021 and will remain open through to Thursday September 30th, 2021, at 12 pm. Tickets purchased before September 3rd, 2021 at 12 pm will be included in the Draw for the First Early Bird prize of $1000 cash on September 3rd, 2021 at 1pm. Additionally Tickets purchased before September 17th, 2021 at 12pm will be included in Draw for the Second Early Bird prize of $1,000 cash on September 17th, 2021 at 1pm. All such tickets, including all winning tickets from Early Bird drawings, will be included in the subsequent cash prize drawings for the applicable Grand Prize Draw of $5,000 plus one-half (50%) of the net raffle ticket sales. The Raffle sales will close on Thursday September 30, 2021 at 12 pm, or such other time as determined by the Greater Pueblo Chamber of Commerce and with the approval of the Secretary of State (the "Entry Period").

HOW TO ENTER

Tickets will be sold for the Raffle throughout the Entry Period. To enter the Raffle, entrant must purchase a Raffle ticket. Tickets may be purchased on-line or at various locations throughout Pueblo. Raffle tickets will be sold in the following amounts: one (1) raffle ticket for $5, three (3) raffle tickets for $10, twenty (20) raffle tickets for $20, one hundred (100) raffle tickets for $50. Raffle tickets may be purchased from various locations as advertised and to be determined locations at the 27th Annual Chile & Frijoles Festival Sept. 24th – 26th in the Historic Union Avenue shopping district throughout the Entry Period. There is no limit on the number of raffle tickets an individual may purchase. All raffle ticket purchases must be completed by the end of the Entry Period to be eligible for the applicable drawing. All raffle ticket purchases are final, and no refunds or replacements will be issued.

WINNER SELECTION

One winner will be selected randomly for each of the two (2) Early Bird Draws and the one (1) Grand Prize Draw. The first early bird draw will take place on Friday September 3rd at 1pm, with the second early bird draw on September 17th at 1 pm, and the Grand Prize Draw taking place at 1pm on Thursday September 30th. All draws will take place at the Greater Pueblo Chamber of Commerce Pueblo, Co. All winning raffle ticket numbers will then be announced, and the winning raffle number will also be posted on the Greater Pueblo Chamber of Commerce’s social media pages and at chiliefest5050.com and will be posted for 30 days. Additionally, purchasers may also contact the Greater Pueblo Chamber of Commerce at 719-542-1704 to check the winning number. Winner need not be present when the winner is announced to win.

PRIZE CLAIM

There are two (2) ways for a winner to claim a prize: (a) if winner is present at the Greater Pueblo Chamber of Commerce when the winning raffle ticket number is announced, the holder of the winning raffle ticket must bring the winning ticket and valid ID to the Greater Pueblo Chamber of Commerce’s office located at 302 N. Santa Fe Ave. Pueblo, Co., where they will receive additional information on how to claim the prize; or (b) if winner is not present at the Greater Pueblo Chamber of Commerce when the winning raffle ticket number is announced, the winner may contact the Greater Pueblo Chamber of Commerce Director of Business & Community Development (Rita Fox) through the Greater Pueblo Chamber of Commerce office within thirty (30) days of the end of the Entry Period, by close of business on Friday October 30th 2021, in order to receive more information on how to claim the prize. The holder of a winning ticket must provide the Greater Pueblo Chamber of Commerce with all information required to claim a prize. In the event: (i) that the winner does not contact the Greater Pueblo Chamber of Commerce within thirty (30) days of the end of the Entry Period (by close of business on October 30, 2021) (ii) that the winner is ruled ineligible for any reason; or (iii) that the winner declines the prize, the prize will be forfeited and will be retained by the Greater Pueblo Chamber of Commerce. The Greater Pueblo Chamber of Commerce has no obligation to contact potential winners. The Greater Pueblo Chamber of Commerce, its members, or any of its entities are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of winner information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen or misdirected winner information. Winners will be required to sign a Declaration of Eligibility attesting to the fact that he/she is 18 years of age or older, as well as other terms and conditions as designated by The Greater Pueblo Chamber of Commerce and consent to the use of his/her likeness in order to collect the prize.

PRIZE DESCRIPTION

One Grand Prize entrant who purchased a wining raffle ticket will receive $5,000 plus one-half (50%) of the net proceeds from raffle ticket sales. The net proceeds being the value of all monies collected from tickets purchased during the duration of the event minus any expenses directly related to the conducting of the raffle. Additionally, two entrants who purchased a winning ticket before the designated early bird deadlines will receive $1,000 cash and will also be eligible for the Grand Prize. All remaining proceeds from the Raffle shall be retained by the Greater Pueblo Chamber of Commerce to offset gaming expenses. All prizes will be delivered via check within thirty (30) days of the winner delivering the winning raffle ticket, executed Declaration of Eligibility, and all other required documents to the Greater Pueblo Chamber of Commerce. For security and safety reasons, no cash payments will be made to the Raffle winner. Unclaimed winnings will be retained by the Greater Pueblo Chamber of Commerce which will be allocated through their programming to enhance community initiatives and resources that will further benefit Pueblo. Registration with the State of Colorado and Applicable Law This Raffle is being conducted pursuant to Bingo-Raffles License # 2021-16741 issued to the Greater Pueblo Chamber of Commerce by the Colorado Secretary of State’s Office, and is being conducted in accordance with the applicable provisions of the Colorado Constitution (Section 2 of Article XVIII), Colorado’s Bingo and Raffles Law (Colorado Revised Statutes, Title 21, Article 24, Part 6), and Colorado’s Rules Covering and Regulating Bingo/Raffles (8 CCR 1505-2). The Raffle is subject to these Rules, the laws of the State of Colorado, and Applicable Law. If there is a conflict between these Rules and the laws of the State of Colorado, the laws of the State of Colorado shall govern. The Greater Pueblo Chamber of Commerce reserves the right to modify the Rules and/or impose additional conditions, procedures, and requirements as may be necessary or required for the Raffle and the award of prizes hereunder to comply with the laws of the State of Colorado and Applicable Law. This Raffle is void where prohibited by law. These rules are copyrighted proprietary materials and may not be copied, reproduced, or used in whole or part in any manner.

TAXES

The prize winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the Raffle, unless otherwise indicated.

ODDS OF WINNING

The odds of winning will depend on the number of eligible entries received.

RELEASE OF LIABILITY AND INDEMNIFICATION

By entering the Raffle, each entrant agrees to follow these Raffle Official Rules and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant may have or that may arise against the Greater Pueblo Chamber of Commerce and each of their subsidiaries and related entities, and the Greater Pueblo Chamber of Commerce (collectively, the "Released Parties"), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prize awarded in the Raffle. By entering the Raffle, each entrant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to attorneys’ fees and/or other legal fees) they may incur as a result of claims made against them in connection with either (i) entrant’s participation; or (ii) the receipt or use of the prize awarded in the Raffle.

PUBLICITY RELEASE

Except where prohibited by law, in consideration for being permitted to participate in this Raffle and the opportunity to win the prize offered in this Raffle, each entrant hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of the entrant’s name, likeness, voice, photograph, performance, personal statements and/or biographical information in any and all advertising, promotions and other publicity conducted by the Greater Pueblo Chamber of Commerce.

RAFFLE CANCELLATION, SUSPENSION OR MODIFICATION

The Greater Pueblo Chamber of Commerce reserves the right to cancel, modify or suspend the Raffle and/or change dates relating to the promotion in case of schedule changes, acts of God, force majeure events, computer viruses, bugs, corruption or unfairness of the security or administration of the Raffle, or for any other reason at the sole discretion of the Greater Pueblo Chamber of Commerce and with the approval of the Secretary of State.

VOID WHERE PROHIBITED

Participation in this Raffle is void where prohibited.
